I want to join my husband/wife in the United Kingdom . What do I have to show to get a spouse visa?

If you are seeking leave to enter the United Kingdom with a view to settlement as the spouse of a person present and settled in the United Kingdom then you have to show that:

  • you are married to a person present and settled in the United Kingdom; or
  • you are married to a person who has a right of abode in the United Kingdom or indefinite leave to enter or remain in the United Kingdom and he is on the same occasion seeking admission to the United Kingdom for the purposes of settlement and is married to you, since which time you both have been living together outside the United Kingdom; and
  • you have sufficient knowledge of the English language and sufficient knowledge about life in the United Kingdom, unless you are under the age of 18 or aged 65 or over at the time you make your application; and
  • you have met your spouse; and
  • you and your husband intend to live permanently together as a married couple and the marriage is subsisting; and
  • there will be adequate accommodation for both of you without recourse to public funds in accommodation which both of you own or occupy exclusively; and
  • that both of you will be able to maintain themselves without recourse to public funds.

If your husband or wife has more than one wife or husband, only one will be allowed to join them in the UK .

At first, you will be allowed to stay and work in the UK for two years. Near the end of this time, if you are still married and intend to continue living together, you can apply to stay permanently in the UK .

If you and your husband or wife has been living together outside the UK for four years or more, and you meet all the necessary requirements to stay permanently in the UK , you may be granted indefinite leave to enter. These requirements include showing that you have the necessary level of knowledge of the English language and life in the UK.
